(College career planning)

The news articles about company trouble.

Resolved Question: How bad & long does a deed in lieu of forclosure affect one’s credit score?
Well here’s my story…I’m no longer able to keep up with the mortagage, falling back 2 - 3 months, barely avoiding forclosure process & the house has been in the market for roughly 1year 2months…it was a terrible sale, too many fixings required that were obviously overlooked in my initial inspections…no remodels done since purchase in april 2004′, but overall a very nice house in a slugish market…have gotten close to sale about 2 months ago, but the buyers weren’t approved(they included repair costs)* I’ve thought about doing a short sale, but to be quite honest it really isn’t a realistic way for anyone to get out of a mortgage by ending up with the difference in the form of debt. Finally I was informed by my bank about “deed in lieu of forclosure” and continue to do my research before starting anything.Does anyone know how bad that would affect ones credit and for how long? I’ve asked financial advisors and have looked online, but have not found the answer to that…Anyone?

> Which Direction For My Career

There comes a time for most people when they ask themselves about which direction they should take for their career. For some, this question is asked before their career even begins, perhaps even before entering college.

In most cases, the sooner you can decide on the direction that you would like to take your career, the better. Forethought and planning can help make the decision making process easier earlier on in your career. The first thing you need to remember is that you will likely not start off at the top of the ladder, but rather that you will need to work your way up to your goal career position.

One of the primary considerations when deciding on the directionality of your career is education requirements. Are there special degrees or certificates that you will need to advance your career and where are they available? Time may be a factor, especially if you are already working in the career field of your choice. There may be options of night schools or correspondence courses to get the degrees and certificates necessary to advance your career.

By defining your goals as clearly as possible, armed with information, you can set a course for career fulfillment and find a time frame that will suit your needs and career advancement.

Deciding on the direction you would like to take your career in is not an easy decision to make, nor one you should make hastily. Take your time and clearly define where you want to be in one year, three years, five years and ten years. Research for information to help you understand what you will need to accomplish to meet these goals.
Interview Techniques

Public speaking seems to be a problem with most people so it is no surprise that most people spend countless hours preparing for an interview as if they are going to speak in front of thousands of people.

Why is the Interview so Important?

Simply said; if you want the job then you better nail the interview. The interview is the gateway to having the job offered to you. If you are confident in your abilities and can vocalize them then you will more then likely receive and offer.

How can I prepare for the Interview?

First thing is to make sure you are well groomed. It is ok to dress up in a dark suit and matching tie for men or a nice dark business suit for women. Men should be clean shaven with a neat hair cut. Women should have their hair neat and also wear stockings and matching shoes. Heals are ok but not to the point where the woman seems awkward walking in them. Another thing you can do is practice what you are going to say to the interviewer in front of a mirror or other people.

Other Interview Techniques

Always shake the interviewers hand firmly, sit straight up, and pay attention. Always make sure to answer the interviewers questions accurately and concisely. It is a good idea to study about the companys history and current events just in case there is a mention of it. Always be prepared and do not let your eyes wander around the room. Do not bite your fingernails or show any signs of outward nervousness. The interviewer will read your body language and even though body language doesnt show your ability to perform a job, the interviewer will still take it into consideration.
Is this Career Right for Me?

Are you happy when you wake up in the morning knowing that you are going in to work? Do you feel as if you have hit your peak at your job? Can you honestly say that you love what you do? Some people can not answer these questions positively and if this is you, then you need to decide if the career you are in is right for you.

First off take the time to go over the different things that you like or love to do daily. Do any of those have anything to do with the career you are currently in? Most people pick careers according to what they liked to do either in school or outside of school. For instance, someone who loves to calculate things and look at problems from an analytical aspect may pursue a career in mathematics, accounting, or some other financial field. There are plenty of self assessing tests out there that will help you to pinpoint your strengths and weaknesses. People who more then likely dont like their careers probably consider it to be something that is mundane and repetitive. They begin to feel like robots in doing the same thing day to day. They need a little change in their lives and their current career doesnt provide them with any hope.

The key to any career path is to figure out what you like to do and apply it to a career. Take some of the tests that are out there to determine what career would be a good fit for you and try the careers that are in that category. If you find later on down the line you realize you made a mistake then slowly transition into a different career path. Trust me; its not the end of the world!

New series of mini-courses introduced for the ESR Safe Hiring Certification Training — the first and only online educational and professional development courses in safe hiring and employment screening.

Novato, CA - Employment Screening Resources (ESR), a leading nationwide pre-employment background screening firm, announced today it has released a new series of mini-courses for the ESR Safe Hiring Certification Training — the first and only online educational and professional development courses in safe hiring and employment screening.

The four new modules enable users to take and complete installments of the ESR 30-hour intensive course. As an approved provider of human resources programs by the Human Resources Certification Institute (HRCI), HR professionals can also take the programs to receive recertification credits.

The online course is the first in-depth training and education opportunity aimed at employers, human resource and security professionals, background screeners and anyone responsible for risk management and due diligence in hiring. The 30-hour course contains 21 self-paced lessons, including a 190-page workbook and study guide and over 300 quiz questions. Each mini-course also includes a workbook and quiz questions. Successful completion of a course leads to a Certificate of Completion, marking a significant professional accomplishment.

The textbook for the course is the "Safe Hiring Manual-The Complete Guide to Keeping Criminals, Terrorists and Imposters Out of Your Workplace," the definitive book on safe hiring and pre-employment screening background checks by ESR President and attorney Lester S. Rosen. (Facts on Demand Press/512 pages).

"Given that the cost of employees is typically the largest single item in any firm’s budget, and employee problems and turnover represent a significant area of exposure to any firm, a professional development and educational course on how to minimize that risk is long overdue," explained attorney Lester S. Rosen, author of the course and president of ESR. "These mini courses are aimed at helping employers and hiring professionals exercise due diligence in hiring," he added, "and to learn techniques to legally and effectively avoid the legal and financial nightmare associated with a bad hire."

The modules focus on the following topics:

·
Safe Hiring-The Legal Landscape, including negligent hiring and the Fair Credit Reporting Act (FCRA);

·
The Effective use of the Application, Interview and Reference Checking Processes and other pre- and post-hire tools;

·
Pre-employment Screening and Criminal Records,

·
The Mechanics of Safe Hiring and Background Checks for Employers.

The courses can be utilized as part of a training program for Human Resources, Security, background screening firms or anyone else with hiring responsibilities. They can also serve as part of an on-the-job training requirement. Completing the courses will help employers demonstrate due diligence, minimize risks related to hiring and reduce costs associated with poor hiring. The courses also provide tools and forms necessary to implement a program for cost-effective screening that also helps provide legal protection. The course also offers a self-audit that measures the effectiveness of the current hiring procedures.

Additional topics include selecting and working with screening firms, international background checks, drug testing, preventing workplace violence, terrorist searches, the pros and cons of databases, preventing theft and embezzlement and Sarbanes-Oxley compliance.

More information about the course is available at: http://www.esrcheck.com/ESRonlineSafeHiringCourse.php.”>http://www.esrcheck.com/ESRonlineSafeHiringCourse.php.

The courses are also offered through BRB Publications, the nation’s premier publisher of sourcebooks used for locating public records.

Top 3 Basic Types of Work at Home Employment<
> Careers, The Correct Qualifications

Knowing what those at the top of your chosen industry have accomplished in order to reach their positions will be one of the most helpful things you can do for your career. Getting these correct qualifications for yourself should be your first priority as far as achieving your goals.

Go online and look at resumes that are posted. Check out the bios of top CEOs. Read articles on the business and as many books as you can find on the industry in which you are interested. Because few people will follow the same path to the top, make a list of entry level, mid level, and upper level positions that different people in the business have acquired. You may find that it is easier to make your way into a related industry and then transfer over to your career of choice. By looking at what those who have come before have done, you can shape your path accordingly.

Education is the logical first step when training for a career. Online classes and night school have made it possible to train for a new career while maintaining your day job. In the event that you need a higher degree that you can’t get through the Internet, there are a variety of grants and loans available to fund your education. If you are confident that the career you are training for is really what you want and that this career will give you the funds to repay the steep fees for a higher degree, this may be the best choice. Networking in grad school may do more for your career than the classes you take.

On the other hand, hands on experience is a great teacher as well. Look for assistantships, internships, and volunteer work in the industry of your choice. You may find that another career is more to your liking. The process of acquiring the correct qualifications for a given career may show you a totally different career that you didn’t even know existed.
Career Planning Considerations

There are a variety of factors to take into consideration when choosing the path you will take toward a new career. You will need to assess what you already possess in terms of skills, education, and experience that will apply to your new career. Next, you should consider what you need to break into the industry. If you have what it takes to get into the industry or are already there, consider what you will need to move to the position that you want. Knowing yourself, your finances, and the industry youve chosen inside and out is essential to career planning. Here are a few questions to ask yourself.

Do you need a degree, a certificate, or a skill set that you can obtain through a class to succeed in your new career?

If so, do you have the time and money to finance this education? Can you take out loans, take your classes online, or take some time off work to get this education?

Do you need to be certified? If so, a very specific career path has most likely been mapped out and followed. Find out what others in your area have done, where they’ve gone to school, and where to register for the exam to pass your certification. This will save you a considerable amount of time as you research what you need to do.

Are you sure this career is what you want? Is the time and money invested in education and entry level positions worth it to you? Will the job pay enough money to finance the lifestyle you want to live? Are the day to day characteristics of your new career compatible with your temperament and values? Realistically assessing your interests and capabilities could save you years if you are honest and sure that you are choosing your new career for the right reasons.

In the past few years the interest in being able to work from home has increased dramatically. The reasons for this trend vary but it’s obvious that having a work at home business has many advantages. Some people simply want to work at home to be closer to their families; others prefer the freedom they gain to become their own boss, etc. Whatever the reason, it looks as though work at home employment is becoming a fast growing market, especially in today?s Internet age. If you are planning on working from the comfort of your home, you might be interested to know about the three basic types of home-based careers available right now. Having a basic knowledge about them will give you a better idea on what best suits your needs.

Work at Home Employment Type # 1: Telecommuting (also called Teleworking)

Telecommuting is not a complete work at home employment; you don’t own your own business. Basically, as a telecommuter you work for someone else. However, the big difference from a traditional job is that you do the majority of your assigned work from your own home. Of course you get some great benefits with this type of work at home employment career: (more…)

Real Home Employment: Possible Or Not?<
> Planning Your Career

One of the most important decisions we make in our lives involves our careers. More than just having a job, a career is a life choice, a journey that we choose for ourselves for gainful employment and fulfillment of our lives. For many people, planning a career begins right after high school when deciding on which college to attend and what courses to take. For others, career planning takes place a little later in life, perhaps after having settled a family and a home.

Planning your career is not too dissimilar to planning a dinner party. There are preparations that need to be made if your dinner party is to be a success. The same preparations need to be made for your career. Look at your career as if it were a ladder, you dont start at the top of the ladder instantly, you work your way up from the bottom or near bottom to get to where you want to be - at the top.

One of the first decisions you need to make is to decide on the career you wish to follow. Researching the career field prior to any further decision making is key. Find out what necessary steps you will need to take in the way of education, certification and experience to get to the pinnacle of your career.

Talking with professionals in the career field of your choice can help you find out and decide which path is best for you to take on your way to the career of your dreams.

Yes, Virginia, there is such thing as real home employment. (You can breathe now.)

But to find it, you will need to do research and you will need to do a pros and cons list of every possible opportunity that you encounter because if you’re going to find something that you can be doing as 2007 rolls in, the program that you take up must MATCH your personality.

That’s right.

If you want real home employment, figure out who you are first. Are you a computer person? Do you see yourself taking surveys? Can you imagine yourself doing affiliate marketing?

This is a VERY IMPORTANT part of the process. You do not want to have to ADAPT to the program that you choose because the amount of time that it will take you to become profitable will be LONGER than with a program or opportunity that you feel is more in your ‘toolbox.’

Employment background checks are becoming increasingly common these days. The reasons for this include the fact that negligent hiring lawsuits that result from the actions of an errant employee can damage a company’s credibility and lead to hefty fines; companies have become more selective in their choice of employees following the threat of terrorist activities; accepting a resume at face value has resulted in many companies wasting time and money due to frequent hire-and-fire situations. Also, more companies are now conducting employee background checks as information from databases all over the world is available online. Employers are not bound to conduct an employment background check in all cases; however, federal and state laws make employment background checks compulsory for jobs that require interacting with children, the infirm, and the aged.

Information that can be included in an employment background check includes driving records, details of past employments, criminal records, military records, educational records, character references, and drug test records. However, background check companies that provide information to employers have to abide by the Fair Credit Reporting Act (FCRA) which regulates the type and amount of information that an external agency can provide to an employer. Education for Self Employment<
> Look Well Into the Future When Career Planning

Although the initial stages of career planning are crucial to success, looking well into the future when career planning is essential if that success is going to be maintained. Careers change, the market changes, the economy changes. If you want to make sure that you remain a hot commodity in your career, you need to make sure that you can roll with the punches.

The best way to look into the future, you must start by looking into the past. What have been the trends of your industry? Where has its competition come from in the past? What companies have survived and which haven’t? Why?

Next, look at the current state of the new industry in which you hope to work and ask the same questions. Choose case studies in the form of major companies. Find out who the key players are in these companies and check out their career path. What did they do after school and entry level positions? Read business journals and check out industry forums online. Where is the current threat coming from? What are people saying about the future of the industry? How will that affect your ability to get a job in your chosen career and keep it five, ten, twenty years down the road?

Now, look at both of these groups of facts and consider your future. What areas will you need to acquire frequent updates on information and skills in order to maintain your position and move up? A certain amount of critical thinking is necessary to prepare yourself for the possible twists and turns of the market as it concerns your chosen career. By assessing the past, taking note of the present, and planning for the future, you will have a much higher chance of not only holding onto your new career but excelling at it as well.
Career Planning Considerations

There are a variety of factors to take into consideration when choosing the path you will take toward a new career. Realistically assessing your interests and capabilities could save you years if you are honest and sure that you are choosing your new career for the right reasons.
Career Planning and Me

Career planning is exactly what it sounds like: planning a career that makes the most of your interests and goals, suits your temperament, and maximizes your education. Traditionally done once at the beginning of adulthood, today this is a process that has become a lifelong endeavor as those in the workforce must keep up with the constant changes of the economy and the demands of our society.

It begins with assessing your current situation, not just financially or at work, but your personal state of mind as well. Do you enjoy organizing things or working within a certain time period and leaving it there when you go home? Are you better at leading people or working alone? Do you prefer to be outside or inside? Do you have political, religious, or moral beliefs that compel you to get involved in a certain field? Anything, absolutely anything that truly inspires you can be made into a career. But first you have to identify what it is that inspires you and why.

Next, take a look around. Is there a name for the job that you want to do or are you a pioneer in the field? Is there a company who is hiring or do you need to create your own? Research what is available, what is lacking, and what is related to what you want to do. Now take your research a step further. Try out an internship or a volunteer position, read books about those who have succeeded in your field, ask to shadow someone who does the job you’re aspiring for. Find out what others had to do to get to where you want to be: other jobs, experience, education. And then decide if it’s something that still interests you.

It’s best to follow these steps for more than one possible career choice, but not more than a few. Unless all of them bombs, you may very well find something that you’d like to try. Enroll in courses if need be or get your resume, interview outfit, and list of companies ready and start applying for entry level positions. Or both. And remember, nothing is ever set in stone. If this doesn’t work out after a few months or you decide you no longer like the career you’ve chosen a year later or 20 years later you can always go back to the drawing board and start again.

Closing the Gap on Career-Family Choices

Women with infants are one of the fastest-growing segments in the U.S. workforce. According to the U.S. Census Bureau, 31 percent of mothers with children under a year old worked in 1976; this number grew to 55 percent in 2002

The Journal of Managerial Issues also found that companies that offered a telework program had greater profits than those that did not offer such benefits.

Three out of four women with children are in the workforce

The United States joins Australia and New Zealand as the only industrialized nations that do not provide paid maternity leave and health benefits by law, according the International Labor Organization. Women in the U.S., depending on the size of the company, can take up to 12 weeks of unpaid, job-protected leave each year for childbirth or the adoption of a child under the U.S. Family and Medical Leave Act of 1993…that is it.

Two incomes is a necessity in many households.

Career or Family? Thanks to a new resource, a choice does not have to be made. Responding to this need of family-friendly employment is a new niche job board to help weed through the sea of non-legitimate family friendly jobs. New England Mother’s Organization lists part-time, tele-commute, job share, and family friendly employment listings each week on the websites job board. It is free to members who access the site through the site, www.nemothers.org. Employers instantly connect to top level job seekers who are still on top of their game but nseek a bit of flexibilty due to family needs. These job seekers are grateful for a company that understands the balance issue and are more loyal.

Employers will gain lots of exposure to their listings and “flexible jobs” are truly a hot benefit in what seekers are looking for in a position. Newscasts commonly report on the fact that the parent of today is looking for flexibility in the workplace. Top companies like IBM, S.C. Johnson & Son, SAS, and Wachovia Corporation know that it pays to offer a family-friendly/company culture. (more…)

> 10 Questions an Interviewer May Ask

Once upon a time job interviews were comprised of a conversation between interviewer and interviewee and based on this conversation, the job seeker was either hired or sent on their way. Within the context of this conversation, questions were asked, but today much of the conversation has disappeared as more and more interviewers are using custom made interview forms. Some of the questions you may encounter include:

1. What is your greatest strength?

2. What is your greatest weakness?

3. Why did you leave your last job?

4. What did you like most about your last job?

5. What did you like least about your last job?

6. How did you solve a problem regarding an angry or dissatisfied customer?

7. How do you handle stress?

8. What would your previous co-workers say about you?

9. Give an example of your ability to make decisions under pressure.

10. Why do you want to work for this company?

There are many variations on the above questions but most of these are pretty standard. Of course, work experience is a given and some employers want to know if you smoke. Often, employers ask questions they are not supposed to ask but it is usually career suicide if you bring up that fact.

The best thing you can do to prepare yourself for any interview is to find out everything you can about the company you are applying for. In addition, make sure you have all the dates clear as to where you worked and how long you worked there. Even if you have already sent a resume take one to the interview with you so that you can glance at it if you need to. Above all, be on time and be prepared!

It has often been said that bad things can happen to you even without your cooperation. That can also be said about jobs and careers. Shortage of available work, mass lay-off and retrenchments, reorganizations and mergers, in today fast pace anything can happen. When it comes, the experience can be devastating for many, made worse when savings are not enough, debts are high and payments are in arrears.

Being prepared is always the best way to cushion the effects of loosing income. Having insurance employment makes you continue to enjoy the benefits of income. Employment insurance can aid you on receiving maternity, sickness compassionate care services, provide support for a member of the family who is ill, caring for an infant, even fishing benefits and many more.

To apply for an employment insurance all you have to do is submit an application online. Employment insurance is paid even when the applicant will receive money when unemployed.

When applying for an employment insurance a “Record of Employment” will be required from you that you will have to get from your last employer or a proof of employment like pay slips, pay stubs and certification.

Other documents that you will need when you apply for an Insurance Employment will include:

Social insurance Number. If your SIN number starts with a 9, that means that you are an immigrant and will need to also supply your immigration status and work permit. You will have to supply a record of employment covering the past 52 weeks When claiming for medical and sickness benefit, a medical certificate will have to be furnished. When applying in person, prepare your driver’s license, passport or a birth certificate. Furnish also complete bank information. (more…)

ADP: ADP National Employment Report Shows United States Employment Declined by 40,000 Private Sector Jobs in December<

ROSELAND, NJ —
Private sector employment declined by 40,000
in December, according to today’s ADP National Employment Report(SM). The
ADP National Employment Report, created by ADP® Employer Services, a
division of Automatic Data Processing, Inc. (ADP), in partnership with
Macroeconomic Advisers, LLC, is based on actual payroll data and measures
the change in total nonfarm private employment each month.

“Given the steadily increasing importance financial markets are placing on
the ADP National Employment Report, we’ve decided to expand its scope,”
said Victor Saliterman, ADP Senior Vice President, Marketing. “Beginning in
early 2007, the Report will be based on a significantly larger sample size
and provide insight into employment in Goods-producing and
Service-providing industry sectors.”

“Total nonfarm private employment declined 40,000 from November to December
on a seasonally adjusted basis, according to the ADP National Employment
Report,” said Joel Prakken, Chairman of Macroeconomic Advisers, LLC.
“These findings suggest an abrupt slowing of employment, following three
months during which, according to the ADP National Employment Report, gains
in private nonfarm employment averaged 121,000 per month.”

Interpreting the Report

Providing real-time information about employment in the United States, the
ADP National Employment Report is an additional assessment of American
business and economic conditions. Findings are represented as both a
monthly employment level number and a change in monthly employment level
number. Employment level represents the total number of private sector
jobs present in the U.S. economy at a single point in time. Change in
monthly employment level represents the increase or decrease in the total
nonfarm private employment level since the prior month.

To obtain additional information about the ADP National Employment Report,
access the full schedule of future release dates, and subscribe to monthly
e-mail alerts and RSS feeds, please visit www.ADPemploymentreport.com. The
January 2007 ADP National Employment Report will be released on Wednesday,
January 31, 2007 at 8:15 a.m. EST.

About the ADP National Employment Report(SM)

The ADP National Employment Report, sponsored by ADP®, was developed and
is maintained by Macroeconomic Advisers, LLC. It is a measure of
employment based on a large, statistically significant, and anonymous
subset of ADP payroll data that represents employees working in all 19 of
the major North American Industrial Classification (NAICS) private
industrial sectors. The data is collected for pay periods that include the
week of the 12th of each month, and processed with statistical
methodologies similar to those used by the U.S. Bureau of Labor Statistics
(the BLS) to compute employment from its monthly survey of establishments.

Empirical analysis performed by Macroeconomic Advisers suggests that the
ADP National Employment Report is a better advance indicator of the monthly
change in establishment employment than available consensus forecasts, and
that it anticipates revisions to the BLS measure.

For a description of the underlying data and the statistical properties of
the series, please see “ADP National Employment Report: Development
Methodology” at http://ADPemploymentreport.com/methodology.aspx.

Unemployment is painful, especially if you’re ready and willing to get to work. Changing that situation quickly could depend on a proven job search strategy. Unfortunately, most job seekers don’t use it or misuse it. But, if you can master it, you can turn your time looking for a job into a matter of days.

First, you have to understand an important statistic. Studies have shown that only about 5 to 10 percent of all new jobs are posted in classified ads or on the internet. The other positions are filled by word of mouth!

So, whether you’re looking for a new job or making some other career change, the way you go about finding the majority of available jobs is to take advantage of “word of mouth.” And you do that through a proven job search strategy called “networking.”

Networking is a vital tool for gathering information, talking to the right people and locking up an opportunity that’s right for you.

Accessing other people, especially ones you already know is simple and straightforward. The only complication is our reluctance to ask other folks for a job. However, if you can put that notion aside and simply approach others for “advice,” you’ll be amazed at how helpful folks are willing to be to “advise” you.

Here are some tips to help you get the most out of networking:

1. Have your ducks in a row. Know precisely what you are looking for that’s consistent with your talents and capabilities. And practice representing yourself out loud before you approach anyone.

2. Never ask anyone for a job or to find you a job. Always ask for advice. It puts you and your contact at ease. And they will feel much more comfortable opening doors for you if they don’t feel under pressure, and you don’t appear as desperate.

3. Prepare a contact bank. This is list of people you know who would be please to offer advice. Or they can introduce you to someone who can be helpful.

4. Be an assertive listener. Your task here is to acquire as much information and insight as possible. And then, when appropriate, you ask you contact to introduce you to other people who can advance your networking. Some of these introductions may mean direct access to a decision-maker who may have an opportunity for you.

Your unemployment blues can be quickly resolved when you master the skills of networking. Fortunately there is a fabulous job (more…)

There are only two types of retirees who would consider retirement employment. One is the person who wants to stay active. The other has no choice.

For many, the cost of living in retirement is becoming too burdensome to think about doing it without income from retirement employment. Two major factors must be considered.

1. According to current life expectancy figures, you could live 20 to 30 years after you retire at 65.

2. The cost of living will more than double during those years, even if inflation averages a modest 3% a year.

To make sure your savings last as long as you do, experts say, you can’t afford to withdraw more than 4% to 5% from your nest egg (more…)

State Court Bias Claims Against Employers Gain Traction
The right to sue an employer for discrimination in state courts is gaining momentum, rattling the nerves of employers who fear more lawsuits and costly jury trials. Beginning Oct. 1, an amendment to Maryland law allows employees to sue employers for discrimination in state court and seek a jury trial, and Illinois employees will gain similar rights beginning next year. Management-side lawyers criticize these changes, which follow 38 other states that already allow for state-court workplace suits.

Ruehl v. Viacom, Inc.
Amended opinion holds that single filing rule, which recognizes exception to exhaustion of
administrative remedies requirement for discrimination plaintiffs who
join class action without filing EEOC charge, cannot be extended to
include individual plaintiffs after class is decertified on ground
that plaintiffs were not “similarly situated.”

Right to Arbitrate Survives Participation in Litigation
A law firm that engaged in emergency litigation with a fired partner has not waived its right to arbitrate other disputes with that partner, New York state’s high court has ruled. The Court of Appeals said a reservation-of-rights provision in a June 2003 settlement preserved the firm’s right to seek arbitration and noted that the firm acted appropriately when the former equity partner brought her employment claims in October 2003.

Factual Employment Screening Part One<
> Starting a New Career

Starting a new career can be a daunting venture, especially when you have acquired a lifetime’s worth of financial responsibilities and obligations. Nothing, however, is impossible, no matter how strapped for time and money you are currently. All it takes is a well thought out plan and diligence and you can soon be starting a new career.

First, think very seriously about what you want to do. Why have you chosen this new career? Is it completely different from what you are doing now? Are there aspects of your current job that apply to your new career as far as contacts, experience, or education? Does this new career require learning a whole new skill set and industry or is it a matter of upgrading your education to the next level? Make a list of all the assets you already possess that you can bring to a new career. Include personal skills and qualifications as well as natural instincts and inclinations. Some things can’t be taught and if you have a natural predilection for the skills needed for your new career, this may take you further than you think.

Next, determine the steps you will need to take in order to arrive at a position in your new career. To help you do this, talk to people currently working the job you have chosen. How did they get where they are? Would they have done anything differently? Do they have any recommendations? Do you need a degree? Online classes and schools are all over the internet and will allow you to study while keeping your job. Do you need an apprenticeship to establish yourself? Try and find one that pays you. Even a small stipend can help you offset financial costs at home.

With planning and patience, you can start a new career without putting your current home situation at risk. Take one step at a time and allow yourself as long as it takes to complete it before going on to the next one. Your new career isn’t going to disappear while you spend time properly preparing for it.
We have all heard in recent years that the need for a substantive policy of conducting pre-and post-employment background checks exists in more than just defense contractor and fiduciary-based enterprises. Today, with the overwhelming preponderance of employer liability litigation, and with negligent hiring being the focal point of round-table discussions of some of the plaintiffs firms, the need for thorough background checks has been substantiated. This is a common sense perspective, not only from the standpoint of getting the best possible people for the job, but also to protect a company form this type of litigation.

In 1979, our company set out to learn how to not only provide the best possible background checks, but also to determine just where factual employment screening would fall in the scheme of things. To understand why screening is where it is today, one needs a little history of the subject.

In the beginning, screening usually started with the security department. These were typically highly qualified, deeply motivated, wholly energetic, recently retired law enforcement professionals who were completely inundated. After being given the entire responsibility for the safety and security of the company, its executives and their families, they were given the task of qualifying those who would pass through the gates each day as employees. Since these individuals were for the most part old boys, they sometimes used, in todays politically correct terminology, improper methods of checking out the applicants.

Employers these days prefer to play it safe rather than be sorry after a hiring decision. Many resumes contain falsified information and hiring such a person might put the company in jeopardy later on. Employers are hiring pre-employment screening agencies to do look into applicant’s backgrounds. Though some companies have an internal department specialized in doing background checks, more and more employers prefer to provide the jobs to companies specialized in such work.

These companies follow legal regulations while doing the background checks and are very through and professional in finishing the job on time. It also does not cost the companies a lot if they tend to go into a contract with a company for some specific period of time.

Youth Unemployment: A Serious Concern of Orissa<

Youth have been recognized as ?the most vital section of the community?. Among the other problems, the youths of Orissa has been facing the unemployment problem In this article, we made an effort to carve some factual information on unemployment problem in Orissa. Besides that, we have also put some light on different issues, steps taken by the government and difficulties to achieve the goal. Above all this article will give you a transparent picture of youth in Orissa.

Not only our future economic soundness but the very soundness of our democratic institutions depends on the determination of our government to give employment to idle men.- Franklin D. Roosevelt

Whenever we are talking about economic development, we cannot ignore young generation. Youth have been recognized as ?the most vital section of the community?. Among the other problems, the youths of Orissa has been facing the unemployment problem. Life for a unemployed youth is very miserable in all aspects. They are in tremendous pressure from all sides. The question ?what are you doing?? without understanding the ground reality of employment opportunity questions the usefulness of his life. The problem lies with the high expectation of the family member and the society, who always nag him without knowing the mental tensions of the youth concerned and the situation around him. So the educated youth rushes after tuition for his livelihood forgetting almost all-important aspects of his life and getting less chance to think for the society and for himself too. Quite appropriately, the problem of youth unemployment has been recognized as an aspect of national unemployment problem. Educated youths have no stable and durable employment. An unemployed youth takes a long time to find work and secures it at an inadequate remuneration since job seekers far outnumber the available opportunities.

An Issue of Concern

Before we confine our self in Orissa, let us put some light on global figures. According to the report on Global Employment Trends for Youth 2004 by the International Labour Organisation, (ILO) Geneva, there are 184 million unemployed people around the world, and among them, 47 per cent are young persons. Around 88 million young people between the ages of 18-24 are unemployed worldwide. India accounts for a major chunk of Asia?s unemployed. By 2001, there were 212 million young people in India, but only 23.6 percent could be absorbed in the labour force. Simultaneously there?s been a marked decrease in the number of jobs on offer from the organized sector (less than 10 percent). As a result, the emphasis of job creation has shifted to the informal sector. As far as Orissa is concerned, growing educated unemployed youth is one of the burning issues of Orissa. According to 2001 census, 38.79% of total population, which accounts 142.76 lakh are total workers in Orissa. Out of the total number of workers, main workers account for 67.2%. The main workers comprise of agricultural labourers (21.9%), cultivators (35.8%), household industries workers (4.2%) and other workers (38.1%). When we calculate the unemployment figure in term of male and female population, 52.5% of the male population and 24.7 percent of female population are workers.

The total unemployment at the beginning of 2004-2005 was 9.97 lakhs. During the year, the additional labour force was 1.87 lakh and the employment generation of 1.94 lakh. So the unemployment (more…)

By assessing the past, taking note of the present, and planning for the future, you will have a much higher chance of not only holding onto your new career but excelling at it as well.

Employment Practices Liability Insurance, also known as EPLI, is a type of insurance that is used to protect a business against a claim that is made against it by workers. This form of insurance specifically deals with claims that state that the legal rights of the workers has been followed. A number of studies have indicated that more employees today are suing their employers than ever before.
While many of these lawsuits may be justified, others are baseless. Even though a large percentage of these lawsuits are filed against large companies, a small to medium sized business is not immune to it. In fact, a small or medium sized bu (more…)

As a regular employee of a company, you are required by the Internal Revenue Service to have withheld from you earnings FICA (Federal Insurance Contributions Act) and Medicare taxes. FICA is also known as the Social Security tax. You pay these taxes into the government and they are used for retired, unemployed, and disabled Americans and their dependants in the form of Social Security payments and Medicare benefits.

The Self Employment (SE) Tax is similar to these aforementioned taxes except that they are for self employed individuals and are imposed on self employed earnings. It allows those who are self employed to be eligible for these benefits later in life, just as an employee is.

The current rate for self employment tax is 15.3%. That percentage is broken down into two (2) parts: 12.4% is for Social Security and 2.9% is for Medicare. Even if you are receiving Social Security or Medicare benefits and no matter your age you are still responsible for the self employment tax.

In order to determine if you are responsible for this tax you must first know if you are considered self employed by the IRS. What exactly qualifies a person as self employed to the IRS you may ask?

According to the IRS you are self-employed if any of these apply to you:

- You carry on a trade or business as a sole proprietor;

- You are a member of a partnership or limited liability company that files a Form 1065, U.S. Return of Partnership that carries on a trade or business; or

The unemployment numbers have risen slightly and yet the economy seems fine although some things have changed. As an executive manager this figure is very important. If the figure goes too low you cannot find decent help to run your company and wages increase and that means it costs more money to produce your goods and services. If the unemployment is too high then no one has a job and cannot buy your goods or services and thus the unemployment numbers are very important indeed.

The unemployment numbers have given back 2% recently and gone from 4.6% to 4.8% which is still pretty low, but that is a big increase in one month. But why is this happening you ask? Well there are many factors too consider, such as college and High School summer labor is now out for summer and since they tend to work cheaper employers may wish to higher them instead. Then there is the issue with increased illegal aliens in the nation, more people same amount of jobs.

Some say the economy is cooling off as well? Indeed a little as the Fed is raising rates and fuel costs are hurting small (more…)

LONDON, UNITED KINGDOM —
After twelve years of campaigning for employment rights for Ministers of Religion, Amicus is celebrating today’s announcement by an Employment Appeals Tribunal that Ministers now have the legal right to claim unfair dismissal.

Amicus say that through cases it has brought on behalf of its clergy members, the law has gradually crept towards granting this basic human right to Ministers of Religion. These include the Helen Percy case brought last year for Sex Discrimination and now the Employment Appeal Tribunal (EAT) case taken by Barrister Daniel Barnett on behalf of the Reverend Sylvester Stewart of the New Testament Church of God.

Amicus National Officer, Rachael Maskell says:”The courts have recognised Amicus’ position that the time has come for Ministers of Religion to be treated with the same human and employment rights as all other workers, so no longer can they be removed from office for no unjustifiable reason, and have nowhere to go to appeal against such injustices.”

Each year Amicus represents over a hundred Ministers across all denominations, only to be frustrated by the legal restrictions which prevent independent resolutions of their cases.

Chair of Amicus Faith Workers Branch, Reverend Dr. Gerry Barlow says:”The announcement by the EAT today means that a new level of fairness has been given to all Ministers which we have been demanding for many years. As a result of this we will use our expertise to help all churches and other faith bodies to develop their policies. Amicus will also continue to promote reconciliation between the parties.”

“From today, I would say to every Minister of Religion, from any denomination or faith, that now is the time to join Amicus Faith Workers, as a professional trade union that can ensure that your interests are now looked after in this new arena of employment rights.”

Amicus represents 2,500 faith workers across all denominations and faiths.

Things to consider before going freelance

  1. Are you self motivated?

You will need to be able to motivate yourself to work on your own initiative.

  2. Are you happy working on your own?

If you are going to be working from home a lot you will need to prepared for the fact that you may be spending a lot of time on your own.

  3. Are you a good organiser?

Not only will you be doing the work, you will need to plan it, do any administration and accounts required.

  4. Do you have enough money for the first couple of months?

Unless you hit the ground at a flying start you will need to be prepared that money may be tight at first. Not only will you be trying to build you business, most clients will want at least 30 days payment terms (and then still may not pay on time)

  5. Do you have a plan?

You don’t necessarily need a full business plan, but you do need to plan how you plan to get work.

  6. Do you have enough experience to go freelance?

It is useful to make sure you have a good grounding in design, so you feel confident to work alone.

Tips for going freelance

  1. Get a good accountant,

If they are good they will save you far more than you will pay them. They know all the things you can and can’t claim for, and will save you money in the long run.

  2. Create a website

Even if web design isn’t your specialty a web portfolio is a simple way to point potential clients to your work.

  3. Write speculative letters to potential clients with a reference to your website and follow up a few days later with a phone call.
  4. Approach design agencies, to see if they require holiday cover or an extra pair of hands when things get busy. Work with design agencies tends to be easier to get than work for direct clients
  5. Contact previous employers

Previous employers may have freelance design work and would be happy to give it to you, as they know your work.

Riding the Waves of Up and Down Pay

Unlike any other job in the world, when you’re self-employed
payment comes in sporadically or not at all. There is no pay
schedule. How do you handle it? Sometimes, when things are
really going right and you’re on top of your self-employment
game, the money comes rolling in. Your paypal address is
hopping, you’re running off to check the mail at the PO box
all the time - you’re practically swimming in checks. But
when it comes down to self employment and getting paid,
nothing is absolute and there are absolutely no rules.

Self employment comes with a lot of self freedom, but also a
lot of up and down pay. Where one month you may make a few
thousand dollars, another month you may only make five
hundred. Some people will pay quite regularly, and send
payments exactly when they say they will. Others you work
with may not respond at all to your e-mails, may keep
changing what they say their payment schedule is, may
suddenly demand something new before they will pay. Self
employment and getting paid don’t necessarily go hand in
hand. You may do work for your self employment and never get
paid for it, in fact.

Depending on how you’re making your self employment a living
for yourself, some who consider hiring you may want to see
samples of your work. Some will want to see samples so
specific, you’ll have to do more work just to complete them.
Don’t ever expect to be paid for samples! In some cases,
you’ll get hired for the job, fueling the self employment
fires, and actually be paid for samples. But when it comes
to self employment and getting paid, you may run into
instances where you do work for free. Some companies may
disappear, never paying you off. Others may ask you to do a
huge project and then reject it completely. Self employment,
unlike any other job, comes with up and down pay.

And, like as not, if you’re serious about self employment
then you have to adjust. Have a savings account. When you
experience those windfalls, spend only what (more…)

When To Make Your Career Move To Self Employment<

A pre employment screening usually involves some basic investigation. The most important and common screening is for the authentication of the data in the resume. Many applicants have fake job experiences in their resumes. This might make the resume look attractive but might prove to be harmful to the applicant if the results turn up that the resume has been falsified. Many people expect the employers to take the resume at face value. Of course, a good resume does provide a good impression but if it is falsified, there could be no chance that the employer would consider the candidate.

Basic verification of the resume includes checking the education records such as if the schools and colleges mentioned do exist and if the candidate has indeed enrolled. This can be available in the school or college records, but the investigator will have access to these only if the investigation is indeed legal and authentic.

Past employment details are also verified and must comply with the details provided at the time of the interview. Referrals will be called and checked for authenticity. The exact reasons for quitting previous jobs also carry a lot of weight. It is very important to check for the applicant?s worker?s compensation history. If the candidate seems to have too many of these cases against the past employers, it is better to make sure the candidate is not in a position to sue the new company also.

Other screenings include the verification of the social security number, driving history, and motor vehicle history. This is most important if the post is for that of a driver or someone in charge of the vehicles in the (more…)
