Florida Appeals Court Finds County Policy Results in Unfair Retaliation
A Broward County, Fla., policy of shutting down internal investigations after employees file federal or state discrimination complaints amounts to improper retaliation, Florida’s 4th District Court of Appeal has ruled. The court issued its opinion in a discrimination case filed against county commissioners by a white bus driver. The county had ended its internal investigation of the driver’s claims after learning that he and another white driver had filed complaints with federal and state agencies.

> Look Well Into the Future When Career Planning

Although the initial stages of career planning are crucial to success, looking well into the future when career planning is essential if that success is going to be maintained. Careers change, the market changes, the economy changes. If you want to make sure that you remain a hot commodity in your career, you need to make sure that you can roll with the punches.

The best way to look into the future, you must start by looking into the past. What have been the trends of your industry? Where has its competition come from in the past? What companies have survived and which haven’t? Why?

Next, look at the current state of the new industry in which you hope to work and ask the same questions. Choose case studies in the form of major companies. Find out who the key players are in these companies and check out their career path. What did they do after school and entry level positions? Read business journals and check out industry forums online. Where is the current threat coming from? What are people saying about the future of the industry? How will that affect your ability to get a job in your chosen career and keep it five, ten, twenty years down the road?

Now, look at both of these groups of facts and consider your future. What areas will you need to acquire frequent updates on information and skills in order to maintain your position and move up? A certain amount of critical thinking is necessary to prepare yourself for the possible twists and turns of the market as it concerns your chosen career. By assessing the past, taking note of the present, and planning for the future, you will have a much higher chance of not only holding onto your new career but excelling at it as well.
Employers these days prefer to play it safe rather than be sorry after a hiring decision. Many resumes contain falsified information and hiring such a person might put the company in jeopardy later on. Employers are hiring pre-employment screening agencies to do look into applicant’s backgrounds. Though some companies have an internal department specialized in doing background checks, more and more employers prefer to provide the jobs to companies specialized in such work.

These companies follow legal regulations while doing the background checks and are very through and professional in finishing the job on time. It also does not cost the companies a lot if they tend to go into a contract with a company for some specific period of time.

These pre-employment screening companies can do some background checks to (more…)

> Which Direction For My Career

There comes a time for most people when they ask themselves about which direction they should take for their career. For some, this question is asked before their career even begins, perhaps even before entering college.

In most cases, the sooner you can decide on the direction that you would like to take your career, the better. Forethought and planning can help make the decision making process easier earlier on in your career. The first thing you need to remember is that you will likely not start off at the top of the ladder, but rather that you will need to work your way up to your goal career position.

One of the primary considerations when deciding on the directionality of your career is education requirements. Are there special degrees or certificates that you will need to advance your career and where are they available? Time may be a factor, especially if you are already working in the career field of your choice. There may be options of night schools or correspondence courses to get the degrees and certificates necessary to advance your career.

By defining your goals as clearly as possible, armed with information, you can set a course for career fulfillment and find a time frame that will suit your needs and career advancement.

Deciding on the direction you would like to take your career in is not an easy decision to make, nor one you should make hastily. Take your time and clearly define where you want to be in one year, three years, five years and ten years. Research for information to help you understand what you will need to accomplish to meet these goals.
Careers, The Correct Qualifications

Knowing what those at the top of your chosen industry have accomplished in order to reach their positions will be one of the most helpful things you can do for your career. Getting these correct qualifications for yourself should be your first priority as far as achieving your goals.

Go online and look at resumes that are posted. Check out the bios of top CEOs. Read articles on the business and as many books as you can find on the industry in which you are interested. Because few people will follow the same path to the top, make a list of entry level, mid level, and upper level positions that different people in the business have acquired. You may find that it is easier to make your way into a related industry and then transfer over to your career of choice. By looking at what those who have come before have done, you can shape your path accordingly.

Education is the logical first step when training for a career. Online classes and night school have made it possible to train for a new career while maintaining your day job. In the event that you need a higher degree that you can’t get through the Internet, there are a variety of grants and loans available to fund your education. If you are confident that the career you are training for is really what you want and that this career will give you the funds to repay the steep fees for a higher degree, this may be the best choice. Networking in grad school may do more for your career than the classes you take.

On the other hand, hands on experience is a great teacher as well. Look for assistantships, internships, and volunteer work in the industry of your choice. You may find that another career is more to your liking. The process of acquiring the correct qualifications for a given career may show you a totally different career that you didn’t even know existed.

Some people can not answer these questions positively and if this is you, then you need to decide if the career you are in is right for you.

First off take the time to go over the different things that you like or love to do daily. Do any of those have anything to do with the career you are currently in? Most people pick careers according to what they liked to do either in school or outside of school. For instance, someone who loves to calculate things and look at problems from an analytical aspect may pursue a career in mathematics, accounting, or some other financial field. There are plenty of self assessing tests out there that will help you to pinpoint your strengths and weaknesses. People who more then likely dont like their careers probably consider it to be something that is mundane and repetitive. They begin to feel like robots in doing the same thing day to day. They need a little change in their lives and their current career doesnt provide them with any hope.

BELLEVUE, WA —
Intelius, Inc., a company that empowers
consumers and businesses with online information for intelligent decisions,
today announced that it will provide free background checks to the Boys &
Girls Club of Bellevue. The Boys & Girls Club of Bellevue will purchase
additional Intelius screening services as needed to further bolster its
commitment to providing a safe place for kids to learn and play after
school.

Effective immediately, the Boys & Girls Club of Bellevue will use Intelius’
Instant Nationwide Employment Checks to verify the identities and
backgrounds of its job and volunteer applicants. The Nationwide Employment
Check includes a sex offender registry check, a nationwide criminal check,
address history, identity verification and more.

“Boys & Girls Club employees and volunteers are responsible for a variety
of duties, including coaching sports activities, leading after school
tutoring and mentoring, and serving as general instructors, referees and
scorekeepers,” explained Kathy Haggart, president and CEO of the Boys and
Girls Club of Bellevue. “We must be absolutely sure that we are doing
everything we can to prevent people who should not have access to our kids
out of the Boys and Girls Club system. With Intelius’ support, we are
taking progressive steps to keep Boys and Girls Clubs safe places where
parents can be confident that their kids are surrounded by positive role
models who have their best interests at heart.”

Jeff Powell, founder of the National Child Safety Foundation and vocal
advocate of background checks for child safety, commended the Boys and
Girls Club of Bellevue for their proactive approach to screening.

“Too often, child care organizations are jolted to take a closer look at
hiring policies only after a child’s safety is compromised or they
experience a close call,” said Powell. “But increasingly, organizations
like the Boys and Girls Club of Bellevue are proactively screening
volunteers and employees, and parents are insisting on that level of
precaution. Intelius is dedicated to giving individuals and organizations
the ability to make better decisions about the safety of our kids. Today,
background checks are convenient, and more accurate and cost-effective than
ever, leaving little excuse for child-centric organizations not to screen.
Kudos to the Boys and Girls Club of Bellevue for doing it right.”

“Child safety is a core value for Intelius, and helping the Boys & Girls
Club of Bellevue create the safest possible environment for kids is one way
we can continue that commitment,” said Edward Petersen, vice president of
sales and marketing for Intelius. “Proactive screening by any organization
that works with children, including childcare providers, youth groups and
after school activity centers is a vital step to ensuring parents have
peace of mind that their children are in good hands. The Boys & Girls Club
of Bellevue is clearly committed to ensuring the safety and enrichment of
the youth it serves.”

Understanding The Self Employment Tax<
> Career Planning and Me

Career planning is exactly what it sounds like: planning a career that makes the most of your interests and goals, suits your temperament, and maximizes your education. Traditionally done once at the beginning of adulthood, today this is a process that has become a lifelong endeavor as those in the workforce must keep up with the constant changes of the economy and the demands of our society.

It begins with assessing your current situation, not just financially or at work, but your personal state of mind as well. Do you enjoy organizing things or working within a certain time period and leaving it there when you go home? Are you better at leading people or working alone? Do you prefer to be outside or inside? Do you have political, religious, or moral beliefs that compel you to get involved in a certain field? Anything, absolutely anything that truly inspires you can be made into a career. But first you have to identify what it is that inspires you and why.

Next, take a look around. Is there a name for the job that you want to do or are you a pioneer in the field? Is there a company who is hiring or do you need to create your own? Research what is available, what is lacking, and what is related to what you want to do. Now take your research a step further. Try out an internship or a volunteer position, read books about those who have succeeded in your field, ask to shadow someone who does the job you’re aspiring for. Find out what others had to do to get to where you want to be: other jobs, experience, education. And then decide if it’s something that still interests you.

It’s best to follow these steps for more than one possible career choice, but not more than a few. Unless all of them bombs, you may very well find something that you’d like to try. Enroll in courses if need be or get your resume, interview outfit, and list of companies ready and start applying for entry level positions. Or both. And remember, nothing is ever set in stone. If this doesn’t work out after a few months or you decide you no longer like the career you’ve chosen a year later or 20 years later you can always go back to the drawing board and start again.

You?ve done it, followed your dream and started your own business, and now reality hits. Income tax time is approaching and it’s time to calculate your taxes.

You need to learn all you can about taxes, just as you learned all you could about your business.

Self employment tax applies to everyone who is self employed and made more than (let?s hope so) $400 a year. It doesn?t matter how old you are, even old enough to collect social security, the federal government wants their part of your income.

When you are employed, your employer shares the tax burden with you, they pay 7.65% of your income and so do you. When you are self employed you get to pay the whole thing, 15.3%. 12.4% goes to pay Social Security and 2.9% for Medicare. But this only applies up to income of $94,200. Above that you only pay the 2.9% for Medicare.

When you are self employed, it is your responsibility to pay quarterly estimated tax payments. If you were employed your employer would do this for you, but since you get to be your own boss, you have to deal with this. Quarterly estimated taxes are due in April, June, Sept. and Jan. If you do not pay them you could be subject to underpayment penalties.

I would recommend that you get the big picture regarding your tax liability. You will need to plan ahead. Take advantage of a free online income tax calculator and estimate your quarterly self employment tax, and calculate your estimated income tax as well. Know ahead what is expected of you. (more…)

Using Employment Newsgroups in Your Job Search<
> Starting a New Career

Starting a new career can be a daunting venture, especially when you have acquired a lifetime’s worth of financial responsibilities and obligations. Nothing, however, is impossible, no matter how strapped for time and money you are currently. All it takes is a well thought out plan and diligence and you can soon be starting a new career.

First, think very seriously about what you want to do. Why have you chosen this new career? Is it completely different from what you are doing now? Are there aspects of your current job that apply to your new career as far as contacts, experience, or education? Does this new career require learning a whole new skill set and industry or is it a matter of upgrading your education to the next level? Make a list of all the assets you already possess that you can bring to a new career. Include personal skills and qualifications as well as natural instincts and inclinations. Some things can’t be taught and if you have a natural predilection for the skills needed for your new career, this may take you further than you think.

Next, determine the steps you will need to take in order to arrive at a position in your new career. To help you do this, talk to people currently working the job you have chosen. How did they get where they are? Would they have done anything differently? Do they have any recommendations? Do you need a degree? Online classes and schools are all over the internet and will allow you to study while keeping your job. Do you need an apprenticeship to establish yourself? Try and find one that pays you. Even a small stipend can help you offset financial costs at home.

With planning and patience, you can start a new career without putting your current home situation at risk. Take one step at a time and allow yourself as long as it takes to complete it before going on to the next one. Your new career isn’t going to disappear while you spend time properly preparing for it.

Employment Newsgroups Job Search Resources

Newsgroups are online, message-based communities of people with common interests.
Each newsgroup is dedicated to a topic, and you may write, search, read and reply
to messages about that topic. Several newsgroups are job and career related.

Some groups are dedicated to employment advertising, while others are dedicated
to resume
submissions, job wanted messages, or general discussions about employment and
careers.
The Usenet Employment Newsgroups are a very productive source of job posting. Thousands
of jobs are posted to the various Newsgroups each day and these opportunities are
often overlooked by most online job seekers. Many Employers,
Recruiters, and Job Sites automatically post their positions to the Newsgroups,

DA certain amount of oversight is involved in almost any job. The more important, the more highly skilled, the more successful the position, the lower the degree of oversight. At the bottom rung of the economic and social ladder - the laborers, the maids, the easily replaceable positions - the more watchful are the powers that be, the less secure are the workers, the more personally vulnerable are they to any mistakes made.

When money or similar valuables are intermixed with poorly paid employees, the level of oversight reaches outsized and intrusive proportions. Diamond workers in South Africa submit to body cavity searches after every shift, a humiliation society normally limits to convicted felons or known drug traffickers.

In the United States, low-level workers in finance and banking are closely observed for cash or figure discrepancies. Too many errors lead inevitably to termination. The larger the amounts of money involved, the more significant the mistakes become. A fast food register a few cents out of balance differs markedly from a bank cashier imbalance of several hundred dollars.

The more pure cash is involved, the more difficulty there is in tracing a paper trail of transactions to establish where a discrepancy occurred. I just returned from three days in Las Vegas, the American capital of cash. Surely nowhere else in the country handles the thousands of hundred dollar bills that change hands in that town, to the tune of several billion dollars annually.

Dealing with Gaps in Employment<

Interview Techniques

Public speaking seems to be a problem with most people so it is no surprise that most people spend countless hours preparing for an interview as if they are going to speak in front of thousands of people.

Why is the Interview so Important?

Simply said; if you want the job then you better nail the interview. The interview is the gateway to having the job offered to you. If you are confident in your abilities and can vocalize them then you will more then likely receive and offer.

How can I prepare for the Interview?

First thing is to make sure you are well groomed. It is ok to dress up in a dark suit and matching tie for men or a nice dark business suit for women. Men should be clean shaven with a neat hair cut. Women should have their hair neat and also wear stockings and matching shoes. Heals are ok but not to the point where the woman seems awkward walking in them. Another thing you can do is practice what you are going to say to the interviewer in front of a mirror or other people.

Other Interview Techniques

Always shake the interviewers hand firmly, sit straight up, and pay attention. Always make sure to answer the interviewers questions accurately and concisely. It is a good idea to study about the companys history and current events just in case there is a mention of it. Always be prepared and do not let your eyes wander around the room. Do not bite your fingernails or show any signs of outward nervousness. The interviewer will read your body language and even though body language doesnt show your ability to perform a job, the interviewer will still take it into consideration.

As an active duty spouse, Karla Kohlenberg found an alternate option to traditional employment. Kohlenberg began a home based business to assure employment. She launched a home based website which offers many advantages to the spouse looking to start a home based business. The business provided only a small startup cost and few overhead expenses. She says there is no pressure to work within any time lines and claims a one year period to running smoothly, as opposed to a five year period offered by most other home based businesses. Studies show that 98% of home businesses fail, but Kohlenberg states that outstanding customer and technical support are key, giving individualized support specific to individual needs

The option is portable since active duty military and their families can be deployed anywhere. Spouses that find themselves overseas may experience difficulty finding acceptable work due to gender and personal safety issues. Spouses must find work inside the military base but they outnumber job availability, which makes a home based business a perfect solution.

Kohlenberg has found that home based businesses provide convenient, flexible schedules rather than a structured, conventional employment site. Availability is 24/7, 365 days of the year. Spouses who have small children can work around the family schedule.

7 Proposals to solve the Unemployment Problem<

DThe subject is constantly in the news and may decide the next national elections the infamous jobless recovery. More than 8 million Americans are out of work with another 4 million underemployed or no longer looking for work. Good manufacturing, technical and services jobs are being shipped to India, Asia, and other developing countries. The mood of the middle and working class becomes more pessimistic, the outlook for their immediate future more grim.
Politicians debate solutions: abrogating current trade treaties, providing protection for various industries, investment in retraining programs, wishful thinking that lower taxes will turn everything around, the promise of a labor shortage within 15 years.
Meanwhile, the population grows, demanding the creation of 150,000 new jobs per month just to stay even. Where are the more than 2 million 2004 jobs promised by the Council of Economic Advisers?
They will come when the government truly invests in the social and financial welfare of the working public. Historically, the U.S. has looked at employment only in times of crisis recession or alarming unemployment figures. Rather than quick fixes, we need a national long-range policy on employment which addresses the issue, in good times and bad, with sustained interest, analysis, and support.
Here are seven proposals:
1. Create a National Office of Employment to develop long term strategies and oversight of the U.S. labor market in order to track trends, analyze data, research emerging problems, and prepare early interventions.
2. Identify growing and potential industries and the skills they will need in future staff.
3. Design a plan which allows for the rapid retargeting of training courses as Community Colleges and vocational schools are traditionally 5 to 15 years behind current needs.
4. Provide substantial tax incentives for businesses to hire in the U.S. rather than shipping their jobs to low income countries.
5. Devise red-tape-less programs to reward employers with significant tax credits for hiring the long-term employed and new trainees.
6. Overhaul the processes of State Unemployment Offices by implementing coordinated support programs in which workers participate as part of receiving unemployment benefits and employers participate as a means of meeting their future needs for staff.
7. Provide incentives for employers to hire more part-time workers. Simultaneously, America must reframe its social policy to promote a new work ethic of reduced work hours, along with increased leisure and volunteer activities, to allow more workers to be employed, albeit for fewer hours. Due to the negative emotional effects of living without work, our society needs to stress high employment rather than high productivity which often translates into fewer workers, working harder and longer.

Planning Your Career

One of the most important decisions we make in our lives involves our careers. More than just having a job, a career is a life choice, a journey that we choose for ourselves for gainful employment and fulfillment of our lives. For many people, planning a career begins right after high school when deciding on which college to attend and what courses to take. For others, career planning takes place a little later in life, perhaps after having settled a family and a home.

Planning your career is not too dissimilar to planning a dinner party. There are preparations that need to be made if your dinner party is to be a success. The same preparations need to be made for your career. Look at your career as if it were a ladder, you dont start at the top of the ladder instantly, you work your way up from the bottom or near bottom to get to where you want to be - at the top.

One of the first decisions you need to make is to decide on the career you wish to follow. Researching the career field prior to any further decision making is key. Find out what necessary steps you will need to take in the way of education, certification and experience to get to the pinnacle of your career.

Talking with professionals in the career field of your choice can help you find out and decide which path is best for you to take on your way to the career of your dreams.

Plaintiffs Lawyers Fear Consequences of Retaliation Ruling
The Ohio Supreme Court recently held that a company was not necessarily being retaliatory just because it sued an employee for making what it considered a bogus sexual discrimination claim. The ruling, which has since popped up on the Web sites of numerous labor and employment firms and employee-rights firms, has plaintiffs lawyers fearing that the door may be opened to company retaliation and that there will be a chilling effect on workers’ ability to report abuses.

N.J. Legislature Passes Bill Expanding Bias-Crime Law to Transsexuals
The New Jersey Legislature this week approved a bill extending to aliens and transsexuals the coverage of civil and criminal laws against bias intimidation. The bill would add “gender identity or expression” and “national origin” to the classes for which bias intimidation is a crime under New Jersey law. The bill would similarly expand state law that makes bias intimidation a civil offense for which damages, including punitive damages, can be recovered, along with attorney fees and costs.

Self-employment tax (SE tax) is a social security and
Medicare tax primarily for individuals who work for
themselves. It is similar to the social security and
Medicare taxes withheld from the pay of most wage earners.

To calculate SE tax use Schedule SE (Form 1040). You can
deduct half of your SE tax in figuring your adjusted gross
income.

SE tax rate
The self-employment tax rate is 15.3%. The rate
consists of two parts: 12.4% for social security (old-age,
survivors, and disability insurance) and 2.9% for Medicare
(hospital insurance).

Maximum earning subject to SE tax
Only the first $90,000 of combined wages, tips, and net
earnings is currently subject to any combination of the
12.4% social security part of SE tax, social security tax.
All your combined wages, tips, and net earnings in 2005,
of at least $400, are subject to any combination of the
2.9% Medicare part of SE tax, social security tax.

Fiscal year filer
If you use a tax year other than the calendar year,
you must use the tax rate and maximum earnings limit
in effect at the beginning of your tax year. Even if
the tax rate or maximum earnings limit changes during
your tax year, continue to use the same rate and
limit throughout your tax year.

Self-employment tax deduction
You can deduct half of your SE tax in figuring your adjusted
gross income. This deduction only affects your income tax.
It does not affect either your net earnings from self-employment
or your SE tax.

Entry Level Recruiter/Account Manager is needed for an Internal Position!!

Top 3 Basic Types of Work at Home Employment<

Career Planning Considerations

There are a variety of factors to take into consideration when choosing the path you will take toward a new career. You will need to assess what you already possess in terms of skills, education, and experience that will apply to your new career. Next, you should consider what you need to break into the industry. If you have what it takes to get into the industry or are already there, consider what you will need to move to the position that you want. Knowing yourself, your finances, and the industry youve chosen inside and out is essential to career planning. Here are a few questions to ask yourself.

Do you need a degree, a certificate, or a skill set that you can obtain through a class to succeed in your new career?

If so, do you have the time and money to finance this education? Can you take out loans, take your classes online, or take some time off work to get this education?

Do you need to be certified? If so, a very specific career path has most likely been mapped out and followed. Find out what others in your area have done, where they’ve gone to school, and where to register for the exam to pass your certification. This will save you a considerable amount of time as you research what you need to do.

Are you sure this career is what you want? Is the time and money invested in education and entry level positions worth it to you? Will the job pay enough money to finance the lifestyle you want to live? Are the day to day characteristics of your new career compatible with your temperament and values? Realistically assessing your interests and capabilities could save you years if you are honest and sure that you are choosing your new career for the right reasons.

In the past few years the interest in being able to work from home has increased dramatically. The reasons for this trend vary but it’s obvious that having a work at home business has many advantages. Some people simply want to work at home to be closer to their families; others prefer the freedom they gain to become their own boss, etc. Whatever the reason, it looks as though work at home employment is becoming a fast growing market, especially in today?s Internet age. If you are planning on working from the comfort of your home, you might be interested to know about the three basic types of home-based careers available right now. Having a basic knowledge about them will give you a better idea on what best suits your needs.

Work at Home Employment Type # 1: Telecommuting (also called Teleworking)

Telecommuting is not a complete work at home employment; you don’t own your own business. Basically, as a telecommuter you work for someone else. However, the big difference from a traditional job is that you do the majority of your assigned work from your own home. Of course you get some great benefits with this type of work at home employment career: (more…)

Employment Contracts<

10 Questions an Interviewer May Ask

Once upon a time job interviews were comprised of a conversation between interviewer and interviewee and based on this conversation, the job seeker was either hired or sent on their way. Within the context of this conversation, questions were asked, but today much of the conversation has disappeared as more and more interviewers are using custom made interview forms. Some of the questions you may encounter include:

1. What is your greatest strength?

2. What is your greatest weakness?

3. Why did you leave your last job?

4. What did you like most about your last job?

5. What did you like least about your last job?

6. How did you solve a problem regarding an angry or dissatisfied customer?

7. How do you handle stress?

8. What would your previous co-workers say about you?

9. Give an example of your ability to make decisions under pressure.

10. Why do you want to work for this company?

There are many variations on the above questions but most of these are pretty standard. Of course, work experience is a given and some employers want to know if you smoke. Often, employers ask questions they are not supposed to ask but it is usually career suicide if you bring up that fact.

The best thing you can do to prepare yourself for any interview is to find out everything you can about the company you are applying for. In addition, make sure you have all the dates clear as to where you worked and how long you worked there. Even if you have already sent a resume take one to the interview with you so that you can glance at it if you need to. Above all, be on time and be prepared!
An employment contract is a documented agreement between an employer and an employee. It is legally binding. The main features of an employment contract are the job portfolio of the employee and the manner in which the employer will make monetary compensation. Companies have a standard format of employment contracts, which are given to all their employees. According to US law, any employee who has been working at least a month is entitled to an employment contract, which must be given to them within two months of commencement of the job.

An employment contract may run into several pages. The first page of the contract contains the names and addresses of both the employer and the employee. It also contains the name and address of the firm, company or institution where the employee is supposed to discharge duties. The date when the contract is made is recorded on the first page.

Following this, the contract contains a brief matter on the job which the employer is to render. The designation or post offered is mentioned. In express contracts, the description of the job portfolio could go in great detail, with a clause to clause explanation of various aspects of the job.

The remuneration to the employee is mentioned in clear terms. Either the salary figure is mentioned directly, or the factors on which payment will be based are mentioned. Period stipulations on payment such as hourly, daily, weekly, monthly, etc. are mentioned. The contract also contains other benefits and perks that the employer is entitled to. Along with these, there is mention of holiday entitlements, sickness benefits, maternity leaves, etc. If there are any reductions in the gross salary, such as due to taxes and insurance, they are also mentioned in the contract itself.

Since the contract is a mutually understood agreement, there may also be clauses that indicate under what circumstances they may be voided. Generally these clauses are at the discretion of the employer. These clauses may state termination of the job under cases of misconduct, low standard of work output, etc. Other disciplinary measures are mentioned in the contract itself.

An employment contract is legally binding on both the employer and the employee. However unsigned contracts and contracts with minors or mentally unstable persons are not recognized by US law.

Failure to obey any of the clauses of the contract by any of the parties involved constitutes breach of contract and it can be sued for in a court of law. The language in a contract must be lucid and clearly convey what is intended. Complex language may lead to misunderstanding and legal wrangles.

Gays, Transgenders Fight for Legal Protections in Utah
Under Utah law, discriminating against gay and transgender people is legal. State Rep. Christine Johnson, D-Salt Lake City, is hoping to change that, by sponsoring a House bill that would add sexual orientation and gender identity to a list of protected classes in the Utah Antidiscrimination Act. Johnson acknowledges that her bill will be a tough sell in Utah, where lawmakers last year refused to remove a state law banning sodomy, although the U.S. Supreme Court struck down a similar Texas law in 2003.

For many years, the business world has been asking higher education to meet their needs of developing future knowledge workers who are self-leaders that take responsibility for their actions and have solid decision making and problem solving skills. An article in the Newsweek’s November 13, 2006 issue indicates that higher education has yet to hear this decades long message.

In this article, a recent graduate of an Ivy League School, shared her experiences that she lacked the fundamentals from completing a W-2 to how to rent an apartment. What was interesting was that she noted that she was not alone. According to her article, she referenced a recent study of career employment (source not cited) that hundreds of employers found new college graduates “woefully unprepared” for the job market.

For years education from K-13 has focused on learning or the acquisition of knowledge, but has miserably failed on performance or the application of knowledge. Universities or higher education continue this tradition and the 21st century is reaping the results ? unprepared workers who are highly intelligent, but can?t negotiate themselves out of a cardboard box.

The University of Michigan Annual Recruiting Trends has documented the needs of employers for over 30 years. In its 2002 report, employers want graduates who have a passion for the position (more…)

Pre-Employment Screening<

A pre employment screening usually involves some basic investigation. The most important and common screening is for the authentication of the data in the resume. Many applicants have fake job experiences in their resumes. This might make the resume look attractive but might prove to be harmful to the applicant if the results turn up that the resume has been falsified. Many people expect the employers to take the resume at face value. Of course, a good resume does provide a good impression but if it is falsified, there could be no chance that the employer would consider the candidate.

Basic verification of the resume includes checking the education records such as if the schools and colleges mentioned do exist and if the candidate has indeed enrolled. This can be available in the school or college records, but the investigator will have access to these only if the investigation is indeed legal and authentic.

Past employment details are also verified and must comply with the details provided at the time of the interview. Referrals will be called and checked for authenticity. The exact reasons for quitting previous jobs also carry a lot of weight. It is very important to check for the applicant?s worker?s compensation history. If the candidate seems to have too many of these cases against the past employers, it is better to make sure the candidate is not in a position to sue the new company also.

Other screenings include the verification of the social security number, driving history, and motor vehicle history. This is most important if the post is for that of a driver or someone in charge of the vehicles in the (more…)

The New York Court of Appeals will decide whether six months is a reasonable time limit for recovery of damages for “AIDS-phobia,” the emotional suffering endured by people who think they may have been exposed to the AIDS virus. The Real Cruise Ship Employment Guide - Securing A Job While Avoiding The Advertising Hype<

Picture yourself plying over thousands of miles of ocean, while occasionally docking at historic ports of call. Not only are you traveling free, you?re getting paid for it, too.

The average cruise ship salary range is between $3,000 to $5,000 per month with zero living expenses and full insurance. The core sacrifice is being away from family for 4 to 6 months at a time. The core benefits are traveling the world, making great money, and meeting great people from around the world.

Most cruise ships built today resemble small cities. The average crew includes: personal trainers, chefs, wait persons, security guards, housekeepers, bartenders, blackjack dealers, and even golf pros. You can find hundreds of other jobs available on each ship.

With an average contract of about six months, and with high turnover rates, it?s obvious why companies need to fill so many positions.

However, for most people, finding one of these dream jobs can be as unpredictable as the treacherous waves in the high seas. Should you mail your application? How about faxing or e-mailing it? Would a direct call to a cruise line company help?

The mountainous information that is available on the Internet can make your job search even more confusing. Much of the information is vague, while other information is misleading, or is a straight up scam.

The Truth

What about web sites that claim to mail, fax and e-mail your application in for you? What are the real chances of getting hired that way? Common sense should tell you, that if someone is sending your application in with 100 others, you?re probably not going to get a job.

With a jovial chuckle, Damien Caldera, a former Carnival Cruises staff member states: ?I don’t know a single hiring manager who employs anyone from any of those faxed or resume e-mail services in the marketplace. It’s just not done. Moreover, it’s a routine to delete and trash this volume of unsolicited applications!”

Richard Marshal, HR Fleet Operations, Management Recruitment, Royal Caribbean International, completely agrees with Damien’s declaration here.

The truth is that cruise ships never advertise 90% of their entry-level jobs. Instead, those jobs are handled by companies like eCruiseShipJobs.com
(http://www.gotravelmagazine.com/cruising.html). Yet, the cruise ship lines own Human Resources Department handles most management level jobs.

ECruiseShipJobs global hiring network is an independent confederation of cruise industry hiring managers with key relationships and hiring access with every major cruise line.

Further Investigation

On further investigation of the countries that supply most of ship crew members, I discovered that all of those countries use crewing agencies. In other words, prospective applicants need to apply through those agencies (who collect fees), and then they are usually employed within months, or within a year. Each agency has direct contact with H.R. personnel from various cruise ships.

Relationships are the easiest way to land a job on a cruise ship. Like the old clich?, ?it?s not what you know, it?s who you know.? The cruise industry is rife with this conduct, mainly, because it?s a hospitality driven industry, and the staff are conditioned to behave this way all the time.

Top 5 ways to get hired on a cruise ship!

1. A referral from a hiring decision maker who works in the Human Resources Dept of a major cruise line. What better way to get a job than to have reference.

2. Get a referral from a friend who has influence within (more…)

Employment Opportunity: “Job Mercenary” Without Knowing It?<
> Interview Techniques

Your employment opportunity and your job candidacy will fail if you’re perceived as a “job mercenary.” Often the “mercenary” attitude is so subtle that we’re not even aware we’re giving off bad vibes.

So, what exactly is a “job mercenary?’ Here are five hints. Could this be you?

1. Believing the employer’s cause is good only as long as the money is good.

2. Harboring a resentment that you’re dependent upon an employer.

3. Lacking an inner job motivation.

4. Holding back or being ambivalent about loyalty to the organization.

5. More concerned about “what I get out of it” that “what I bring to the table?”

Obviously these are not traits you would deliberately communicate in an interview or in a face-to-face meeting with the person who could be your next boss. But if you haven’t taken the time to identify them in yourself, they will surely creep into your attitude. And employers’ antennae are fine-tuned to pick up on these subtleties.

There are three important attitudinal adjustments you should make and demonstrate as part of your employment opportunity. They can counter any of these “mercenary” tendencies and dispel any hidden concerns an employer could be harboring:

* Loyalty. This does not mean that you have to agree with everything an employer or organizational policy represents. Loyalty means you share a common ideal with the employer. You communicate that regardless of minor differences, you’re prepared to fight shoulder-to-shoulder with confidence in the company’s good faith.

* Values. Understanding what your personal underlying business values are. And then showing how they are in harmony with those of the company.

* Compatibility. Individuals can create a team. But compatible individuals produce the best team. If you’re touchy and thin-skinned in an interview, the employer instinctively knows you will be abrupt and abrasive on the job. On the other hand, a go-along person attracts people like themselves.

Remember, what you communicate to an employer below the radar is often more telling that what you say out loud. Putting a check on your mercenary tendencies will go a long way to ensure your employment opportunity success.

Unemployment Blues: The Value of Temporary Work<
> Careers, The Correct Qualifications

Although the job market has improved over the past year, many employers are still reluctant to make a long term commitment to growing their employee rolls until it is clear that a solid economic expansion is underway. They need new staff to handle the increase in orders and customer demands but are loath to hire permanent workers who may have to be cut in a few months if business stagnates. Any reduction in force carries major headaches for a company: employee morale falls, lawsuits arise, precious time is eaten up in non-productive meetings, and severance packages cut into narrowing profit margins.

Their solution is often to rely on temporary agencies to provide needed manpower without any precipitous long term commitment. It is estimated, by a well-regarded labor research group, that fully 25% of the jobs created during the past year have been temporary positions!

How can this work to your advantage?

Working for a temporary agency has some drawbacks but also a number of positive aspects.

The primary negative is the lack of investment in your future. While the hourly wage may be similar, or even better, than a (more…)

Employment - Disclosure of Information - Breach of Confidence<

The defendant resigned and found employment with one of the claimant?s competitors. Shortly after her resignation, the claimant discovered that the defendant had sent three e-mails to her personal e-mail account prior to leaving the company. The e-mails concerned:

* Presentations she had made to the claimant?s customers;

* Feedback which customers had given in relation to the claimant?s services; and

* Prices of the claimant?s products.

The claimant was of the opinion that the information contained in the e-mails was confidential and therefore violated the terms of the defendant?s contract of employment. The claimant confronted the defendant with its discovery.
